Below you will find our sales conditions that apply to an agreement between the buyer and Omnia Tempus.

1: Content

The general conditions mentioned below govern the relationship between the customer and the webshop of Omnia Tempus. Each visit to and any sale via the website implies the customer's full acceptance without reservation of the general conditions discussed below. Omnia Tempus reserves the right to amend the conditions listed on this website at any time without prior notice and in accordance with Belgian general law.

A great deal of time and effort has been invested in presenting, describing, and depicting the items sold on this website. Should there be an error regarding price or specifications on our website despite the precautions taken to do this correctly, we cannot be held liable for this.

Also considering the fact that images are purely indicative. Our products are never identical, which means that no guarantee can be given on the specifically chosen product.

 

2: Prices

Displayed prices are always valid on the day of consultation or for the possibly mentioned validity period.

All prices are exclusive of shipping costs, any applicable import taxes and duties depending on the country of shipment.

If there is a VAT adjustment, Omnia Tempus has the right to make this adjustment on all relevant invoices.


3: Purchase Agreement

3.1 The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the conditions set therein. If the online payment is not executed for any reason, this does not remove the obligation to pay the price, which must be settled by bank transfer to the account number indicated on the invoice, within the due date specified on the invoice.

3.2 If the consumer has accepted the offer electronically, Omnia Tempus will promptly confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the consumer may cancel the agreement.

3.3 If the agreement is concluded electronically, Omnia Tempus will take appropriate technical and organisational measures to secure the electronic transfer of data and will ensure a safe web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures.

3.4 Omnia Tempus may, within legal frameworks, ascertain whether the consumer can meet their payment obligations, as well as all facts and factors that are relevant for responsibly entering into the sales agreement. If Omnia Tempus has good grounds based on this investigation not to enter into the agreement, it is entitled to refuse an order or request with justification or to attach special conditions to the execution.

3.5 Omnia Tempus will provide the consumer with the following information in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable data carrier:

a. The address of the Omnia Tempus location where the consumer can go with complaints;

b. The conditions under which and the manner in which the consumer can exercise the right of withdrawal, or a clear notification regarding the exclusion of the right of withdrawal;

c. Information about existing after-sales service and guarantees;

d. The information included in Article 4, paragraph 3 of these terms, unless Omnia Tempus has already provided this information to the consumer prior to the execution of the agreement.

3.6 If Omnia Tempus has committed to delivering a series of products or services, the provision in the previous paragraph only applies to the first delivery.


4: Your personal data

Your personal data will be used by Omnia Tempus for the confirmation, invoicing, and delivery of your order. When creating and managing your user profile, you are at all times responsible for the accuracy of the data. In the event of errors in the address, billing, or other personal data, Omnia Tempus cannot be held liable for the inability to fulfil its obligations (e.g. delivery or notification). You are also responsible for the confidentiality of the password associated with this user profile. Under 18 years of age, this website may only be used with the consent of a parent or guardian.


5: Delivery and rates

The place of delivery is the shop or, in the case of distance contracts, the address provided by the Customer to OT. Delivery will be carried out after payment of the full purchase price. The Customer acknowledges that the delivery period, even in the case of a distance contract, is only indicative.

Omnia Tempus will do everything possible to deliver goods within the stated delivery period. No delay can give rise to the termination of the contract to the detriment of OT, nor to a penalty or compensation.

OT cannot be held liable for late delivery due to the actions of one of its suppliers.

The Customer is obliged to make the receipt of products ordered for delivery possible.

In particular, the Customer must be present and reachable at the agreed time. If delivery at the agreed time is not possible, a refund of the product will take place. The delivery costs will not be refunded in this case.

A flat fee of 85 euros will be withheld.

Applicable rates calculated from the head office:

5.1 Shipping costs are inevitable with an online shop and no one likes to pay them.

To keep the product prices of OT clear, we have chosen not to include the shipping costs in the product price, allowing us to say that shipping is free.

After all, when purchasing multiple products, it is more advantageous for the customer to pay the actual shipping costs.

5.2 Within Belgium:

5.2.1 - Package: 8.30 euros if your order weighs less than 30 kg and does not indicate oversized.

5.2.2 - For over 30 kg or an oversized item, the following rates apply:

- BE Zone 1 - Province of Antwerp: 45€

- BE Zone 2 - Provinces of Flemish Brabant, Walloon Brabant, Limburg, East Flanders: 55€

- BE Zone 3 - Provinces of West Flanders, Hainaut, Liège, Namur: 85€

- BE Zone 4 - Province of Luxembourg: 100€

5.3. Netherlands:                                                                                                                                                                             

5.3.1 - Package: 13.50 € if your order weighs less than 30 kg and does not indicate oversized.

5.3.2 - For over 30 kg or an oversized item, the following rates apply:

- NL Zone 1 - Provinces of Limburg, North Brabant, Zeeland: 95€

- NL Zone 2 - Provinces of Gelderland, Utrecht, South Holland: 125€

- NL Zone 3 - Provinces of Flevoland, North Holland, Overijssel: 150€

- NL Zone 4 - Provinces of Drenthe, Friesland, Groningen: 175€

5.4. Rates outside Belgium & the Netherlands are always available upon request.

 

5.5. All our shipments are provided with a Track & Trace number so you can follow them.Shipments are scheduled after receipt of payment within 7 calendar days if the item is in stock.

For the Netherlands, please inquire about our specific delivery days.

5.6. Shipping large and fragile items:

Sometimes certain items cannot be shipped, but can only be picked up or possibly delivered to your home at different delivery costs

(due to being too fragile or too large). This will be explicitly stated with the product.


6. Collection:

You may also choose to pick up your package from us; in that case, you will never pay shipping costs.

Note: after clicking on "collect", the delivery costs will only disappear from your shopping cart.

 

7: Giveaway or competitions (Favors)

It is the responsibility of the person or company that receives a giveaway or won items to arrange the transport of these goods themselves. These must be collected within 14 calendar days, or another winner will be drawn. Under no circumstances can the winning party claim an acquired right as it concerns a favour that is of limited duration. If there is a suspicion of intentional fraud, Omnia Tempus may unconditionally suspend the competition at any time or refuse the winner the won items.

 

8: Liability for transport damage

Before shipping, all items undergo quality control and are packaged according to the rules of the art. The customer agrees to check the order immediately upon receipt and to inform us within 24 hours of any damage. This can be done via email, and a photo of the damaged item, packaging materials, and box with address label should be included. These photos are essential for the preparation of the damage file. Therefore, never throw away the packaging until you have confirmed that your order is in good condition. Returns must always be done in consultation, so never send a shipment back to us on your own initiative.


9: Right of Withdrawal

9.1. If you are not satisfied with your purchase, you have the option to withdraw from the purchase without giving any reason and return the item to us. You must inform us in writing or via email within 14 working days after delivery of the product that you wish to withdraw from the purchase. You may use the attached model form for this purpose, but you are not obliged to do so.

9.2. This does not apply to VAT-liable persons according to general Belgian law.

9.3. The item must be returned in its original packaging, in undamaged and unused condition, and sufficiently stamped, with your order number indicated. Returns are at the sender's own cost and risk, in this case, the customer. Unannounced returns will not be credited.

   

9.4. The right of return does not apply to custom-made or personalised products, as well as sale items.

9.5. Items returned to us under the conditions described above will be refunded within 30 days of return by Omnia Tempus in the form of a voucher from Omnia Tempus. If it concerns an item that was incorrectly delivered by Omnia Tempus,

we will cover all return shipping costs.

9.6. We reserve the right to refuse returns if we suspect that the items have already been used or if there is suspicion of damage caused by fault other than Omnia Tempus or the supplier of the item.


10: Warranty

10.1. Under the law of 21 September 2004 regarding the protection of consumers in the sale of consumer goods, the consumer has legal rights.

This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

10.2. To invoke the warranty, the customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

10.3. For items purchased online and delivered to the customer, the customer must contact Omnia Tempus and return the item at their own expense to Omnia Tempus.

10.4. In the event of a visible defect, the Customer must inform Omnia Tempus within 24 hours of delivery.

10.5. The (commercial and/or legal) warranty does not apply to defects arising from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.

10.6. Defects that manifest after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless proven otherwise by the customer.

10.7. Depending on the climate (dry or humid environments), our wooden products may exhibit colour differences, shrinkage cracks, splits and/or fissures. These characteristics are inherent to the natural material of the products offered by the seller and depend on the climate to which the product is exposed. Therefore, ensure the correct humidity and temperature during the first 6 months after installation in the home. (50 to 60% humidity, 18 to 22°C)

The seller cannot provide any warranty in this regard.

10.8. Repairs to the item, whether under warranty or not, must always be carried out in our workshop. It is therefore the customer's responsibility to bring/send the item to our workshop, always by appointment.

    

11: Payment

Payments on the Omnia Tempus website are processed through the company Mollie, which specialises in 100% secure online payments. You can pay with Bancontact/Mister Cash, iDEAL or bank transfer.

This means that at the moment of your payment by bank card, the validity of the access rights is automatically checked and all exchanges of information are scrambled to ensure confidentiality. The exchange of sensitive information such as your bank card number takes place between the customer and the 100% secure site of the company Mollie. Omnia Tempus or unwanted visitors do not have access to this information. At the moment you provide your bank card number, you are no longer on our servers, but on the secure servers of the company Mollie.


12: Ownership Rights

Omnia Tempus remains the full owner of a sold item until the purchase price has been fully paid.


13: Applicable Law and Competent Courts

Belgian law applies to all agreements between the websites of Omnia Tempus and the customer. In the event of a dispute, the Court of Mechelen has exclusive jurisdiction.

All disputes fall under the exclusive jurisdiction of our registered office. Information on alternative dispute resolution can be found via this link: http://ec.europa.eu/odc/ but we reserve the right to submit disputes exclusively to the courts.
